BackgroundFrance has long been a country of immigration and in some respects may be seen to have a generous policy with respect to asylum seekers and access to health care for migrants. The French state notably provides healthcare access for undocumented migrants, through state medical aid and since 1998 has had a humanitarian policy for granting temporary residence permits for medical reason to migrants. Within a context of political debate, reform and tightening immigration control we will examine this latter policy (...) focusing especially on the dilemmas that arise for physicians of migrant patients when they are requested to write medical certificates as part of a TRPMR application. In a 2017 reform the key role of making recommendations on the granting or not of permits was handed over to Ministry of the Interior health inspectors. Recommendations are made after perusal of medical certificates established by the migrant’s physician and complementary evidence.Main bodyThe writing of medical certificates by a physician would seem straightforward. This is far from the case since it raises a number of ethical dilemmas. These occur within a physician-patient relationship embedded within a social contract between the State, the physician and the migrant patient. To clarify the ethical issues arising 3 vignettes based on practice within an infectious disease unit at a large Paris hospital have been developed. The vignettes highlight ethical dilemmas in the care for migrants with tuberculosis, chronic hepatitis, and HIV / AIDS. We will go on to reflect on issues of social justice and responsibility for the health of migrants within a globalized world.ConclusionsCriteria for residence permit delivery appear less than clear-cut and are interpreted in a restrictive way. Neither are the consequences of refusing a residence permit taken into account. We call for an empirical transnational ethics study involving countries implementing similar TRPMR policies. We also call for inclusion of lobbying competences into the medical undergraduate curricula, in order to breed future generations of physicians skilled in defending social justice. (shrink)

In everyday conversation, messages are often communicated indirectly, implicitly. Why do we seem to communicate so inefficiently? How speakers choose to express a message (modulating confidence, using less explicit formulations) has been proposed to impact how committed they will appear to be to its content. This commitment can be assessed in terms of accountability – is the speaker held accountable for what they communicated? – and deniability – can the speaker plausibly deny they intended to communicate it? We investigated two (...) factors that may influence commitment to implicitly conveyed messages. In a preregistered online study, we tested the hypothesis that the degree of meaning strength (strongly or weakly communicated) and the level of meaning used by the speaker (an enrichment or a conversational implicature) modulate accountability and plausible deniability. Our results show that both meaning strength and level of meaning influence speaker accountability and plausible deniability. Participants perceived enrichments to be harder to deny than conversational implicatures, and strongly implied content as more difficult to deny than weakly implied content. Furthermore, participants held the speaker more accountable to content conveyed via an enrichment than to content conveyed via an implicature. These results corroborate previously found differences between levels of meaning (enrichment vs. implicature). They also highlight the largely understudied role of meaning strength as a cue to speaker commitment in communication. (shrink)

Transformative and mutually beneficial solutions require decision-makers to reconcile present- and future interests and to align them with those of other decision-makers. Despite the natural co-occurrence of intrapersonal and interpersonal conflicts in the transformation toward sustainability, both types of conflicts have been studied predominantly in isolation. In this conceptual article, we breathe new life into the traditional dialog between individual decision-making and negotiation research and address critical psychological barriers to the transformation toward sustainability. In particular, we argue that research on (...) intrapersonal and interpersonal conflicts should be tightly integrated to provide a richer understanding of the interplay between these conflicts. We propose a novel, unifying framework of interdependent conflicts that systematically structures this interplay, and we analyze how complex interdependencies between the social and temporal dimensions pose fundamental psychological barriers to mutually beneficial solutions. Since challenges to conflict resolution in the transformation toward sustainability emerge not only between individual decision-makers but also frequently between groups of decision-makers, we scale the framework up to the level of social groups and thereby provide an interdependent-conflicts perspective on the interplay between intra- and intergenerational conflicts. Overall, we propose simple, testable propositions, identify intervention approaches, and apply them to transition management. By analyzing the challenges faced by negotiating parties during interdependent conflicts and highlighting potential intervention approaches, we contribute to the transformation toward sustainability. Finally, we discuss implications of the framework and point to avenues for future research. (shrink)

Vocational ethics and vocational moral socialization are important for the business ethical climate in a given country and in a given industry, but have not received attention in the literature. Our article suggests vocational ethics as a legitimate sub-specialty for business ethics research and development. The article addresses the exposure of vocational students to a combination of vocational school-based and workplace-based socialization, and outlines an agenda for teaching-oriented research and research-based teaching. More specifically, we first draft a conceptual frame of (...) reference and then report results and experiences from a scenario-based pilot study at one of the biggest vocational schools in the country. As a third step such a preliminary situation analysis inspires a number of suggestions for how one could start with developing this field, practically, empirically and theoretically. (shrink)

A target question for the scientific study of consciousness is how dimensions of consciousness, such as the ability to feel pain and pleasure or reflect on one’s own experience, vary in different states and animal species. Considering the tight link between consciousness and moral status, answers to these questions have implications for law and ethics. Here we point out that given this link, the scientific community studying consciousness may face implicit pressure to carry out certain research programs or interpret results (...) in ways that justify current norms rather than challenge them. We show that because consciousness largely determines moral status, the use of nonhuman animals in the scientific study of consciousness introduces a direct conflict between scientific relevance and ethics—the more scientifically valuable an animal model is for studying consciousness, the more difficult it becomes to ethically justify compromises to its well-being for consciousness research. Finally, in light of these considerations, we call for a discussion of the immediate ethical corollaries of the body of knowledge that has accumulated and for a more explicit consideration of the role of ideology and ethics in the scientific study of consciousness. The disease of love appears in an unbroken chain of medical treatises stretching from sixth-century Byzantium through the Middle Ages to post-Renaissance Western Europe. Lovesickness, known variously as amor eros, amor heros, or amor hereos in medieval Latin medical texts, has attracted the attention of literary scholars because many of its symptoms correspond to conventional signs of love in medieval literature. According to George Lyman Kittredge, “What to the physician were symptoms … became, in the chivalric system, duties — ideals (...) of emotion which the true lover must live up to, and which the hypocrite takes pains to counterfeit.” In the late thirteenth century the Catalan physician Arnald of Villanova explicitly compared the disease of love and feudal service in his Tractatus de amore heroico. He claimed that this love “is called heroic as though lordly , not only because it befalls lords, but also either because it dominates, subjugating the soul and ruling a man's heart, or because the acts of such lovers toward the desired object are similar to the acts of servants toward their lords.”. INSPIRED by a dynamist Naturphilosophie and looking for a mathematics of the natura naturans, the founders of modern mathematics in Germany made some lasting contributions in the attempt to go beyond perceptible space. Hermann Grassmann’s extension theory, Johann Benedict Listing’s topology, Bernhard Riemann’s non-Euclidean manifold theory, Carl Gustav Jacob Jacobi’s approach to non-mechanistic theory and last but not least Georg Cantor’s transfinite set theory were all influenced by the tradition of Naturphilosophie. One central motivation for the new mathematics was to (...) decipher the so-called “inner side of nature” which was thought to be invisible but nonetheless physical. As a result, mathematics was understood not only in terms of quantity but of morphogenetic quality and as a tool to recognize the intrinsic possibilities of structuring and organizing nature. This essay focuses on the philosophical viewpoints of Christian Samuel Weiss, Justus and Hermann Grassmann, Bernhard Riemann and their reception of Schelling’s philosophy. Riemann deconstructed empiricist theories of space so as to glean the fundamental constitution of space. One result was that a given, fixed and static metric is not necessary for the understanding of space. The underlying topological substratum has no specific metric but is capable of exhibiting any possible metric. Riemann’s claims are compared with Schelling’s theory of space in his “Darstellung des Naturprocesses”. My thesis is that Schelling’s philosophy of the emergence of space can be read in Riemannian terms and that it is an interesting model in the context of modern questions. (shrink)

In 1837 the German-born astronomer F. G. W. Struve published his famous catalogue of double stars. For Struve this was the culmination of 12 years' detailed observation of a class of celestial objects lying exclusively beyond the solar system; for historians of astronomy it poses the problem of explaining why the study of double stars became a significant part of astronomical endeavour, as it did, during the 1820s and 1830s. For, although Struve's interest was extreme, it was shared to a (...) lesser extent by several eminent contemporaries, including John Herschel, Friedrich Bessel, Johann Encke, James South and Félix Savary. Their combined efforts represented an important transition in astronomy: for the first time one of the emphases of the subject moved beyond the solar system to the so-called fixed stars. The question of the emergence of interest in double stars is of historical significance, therefore, as it is related to the problem of the origins of ‘stellar astronomy’. This essay is thus intended to offer an explanation of astronomers' interest in double stars, and to tackle the related question of whether this transition constituted a major break in the history of astronomy. Furthermore it is proposed that answers to these problems may be found by considering the practice of astronomy dominant during the first half of the nineteenth century. Astronomers in this period were overwhelmingly concerned with a refined form of positional astronomy. The problems they chose to solve were by and large related to the difficulties of the accurate reduction of observational data, and the compilation of reliable tables and star charts, which were then used as a background against which the motions of solar system objects were plotted. By assessing individuals' studies of double stars within this context it can be seen firstly that such studies were no more or less than specific examples of a general case, and secondly that the stars themselves were not usually of intrinsic interest. Kierkegaard is an exegetical interpretation of Søren Kierkegaard's Philosophical Fragments and Concluding Unscientific Postscript. Vivaldi Jean-Marie elaborates on the philosophical and religious arguments of the pseudonym Johannes Climacus to demonstrate that history is propatory toward the achievement of eternal happiness. The author emphasizes Kierkegaard's heritage in the Post-Kantian tradition by discussing his critique of the Romantics and German Idealists. The exposition of Philosophical Fragments and Concluding Unscientific Postscript is carried out on the basis of the ongoing conversation between (...) Climacus and the Post-Kantian tradition to argue that Climacus wishes to show the limitation of history and philosophy and the necessity of subjective appropriation to transcend the shortcoming of history and philosophy. Climacus's assessment of the prevailing Christian attitudes of the 19th century maps out the possibility of subjective religious experience in freedom. (shrink)

Johannes Drerup schlägt für normativ-politische Kontroversen ein Kriterium vor, anhand dessen bestimmt werden soll, wann diese Kontroversen legitime Unterrichtsthemen sind und in Folge dem Kontroversitätsgebot unterliegen. Dies ist dann der Fall, wenn für kontroverse Fragen „auf Basis politischer Grundwerte und -prinzipien, die als konstitutiv gelten können für die Ermöglichung eines guten persönlichen und politischen Lebens in liberal-demokratischen Staaten, keine eindeutige Antwort abgeleitet werden kann.“ Zu diesen Grundwerten und -prinzipien zählt Drerup auch „Grund- und Menschenechte“. Mein kurzer Beitrag möchte zeigen, (...) weshalb Drerups an sich fruchtbarer Ansatz die Komplexität des Maßstabes „Grundund Menschenrechte“ tendenziell unterschätzt und insbesondere das Verhältnis von Demokratie und Menschenrechten zu wenig als potenzielles Spannungsverhältnis ernst nimmt. Ich schlage daher weitere Differenzierungen vor, um Drerups Kriterium konzeptionell zu schärfen. Zudem rege ich an, Kontroversen, die Drerups Kriterium nicht genügen, aus didaktischen Gründen dennoch eine gewisse Anfangs-Kontroversität zuzugestehen, um die Bedeutung der betreffenden Grundprinzipien, die als „rote Linien“ fungieren, deutlicher herausarbeiten zu können. Washington, D.C.: The Catholic University of America Press, 1993. Pp. 541. $24.95 (paper). The Church, Community of Salvation: An Ecumenical Ecclesiology. By GEORGE H. TAVARD. Collegeville, Minnesota: The Liturgical Press, 1992. Pp. 264. $18.95 (paper). These two works represent two recent and very different attempts by contemporary Catholic ecclesiologists (...) to present a comprehensive or systematic theology of the church. I shall deal with the specifics of each work separately. Johann Auer (1910-1989) was professor of dogmatics and the history of dogma at the University of Bonn when in 1983 he first published his Die Kirche: Das allgemeine Heilssakrament. This present work is an English translation of that German text which was Volume VIII in a comprehensive, nine-part, dogmatic survey, with volumes addressing the traditional dogmatic themes: God, Creation, Christ, Grace, Eucharist, Sacraments, Church and Eschatology. Joseph Ratzinger was co-editor with Auer of the original series. And while Auer authored the first eight volumes, Ratzinger authored the final volume on eschatology. We have seen this kind of dogmatic survey in English before in the comparable six-volume work of Michael Schmaus called Dogma (1968). As with Schmaus's work, this dogmatic survey is intended as a series of textbooks for theology students and thus its method is to survey each dogmatic theme focusing upon three elements, the biblical foundation for the theme, the historical development of this theme, and finally its systematic inner coherence or integral rational development. In this volume, Auer accomplishes all three tasks in exemplary fashion and with a depth of treatment Schmaus never aimed at approaching. Auer's The Church is divided into eighteen chapters organized into four thematic sections bearing the titles, " Pathways towards the Proper Understanding of the Church," " Pathways towards a Theological Concept of the Church taken from Biblical Images," "Manifestations of the Church's Being, Life and Activity in the Light of its Sacramental Structure," and "The Church's Tasks and Its Ways to Self-Realization in the World." Under these titles are treated all the traditional themes expected of a comprehensive ecclesiology: the origin and authority of the church, its mission and ministries, biblical images, organizational BOOK REVIEWS 141 models and dogmatic marks of the church, ecumenism, the place of the Blessed Virgin Mary among the People of God, relations between church and state. Auer's consideration of each of these themes is marked by his thorough knowledge of the sources and his skillful handling of these materials. Even so, Auer's work is hardly beyond criticism. For example, arguably the heart of the book is the author's 213-page treatment of the history and theology of the ministries which comprises Part III, "Manifestations of the Church's Being, Life and Activity...." I want to call this section masterful because of the vastness of the enterprise (the development of the ministries over almost two thousand years) and the wealth of careful distinctions Auer brings to his treatment of so much material. To choose among the riches here one might single out Auer's treatment of the two principles of democracy and hierarchy and the numerous collegial forms for participative governance and administration that have been created or once existed in the church and have been revived since Vatican II (pp. 157-173). This is a stimulating but balanced discussion, blending historical material with more immediate and urgent concerns. But there are also some serious weaknesses in the larger section. For example, while extended attention is given to the offices of bishop and pope (almost a hundred pages on the papal office alone), comparatively little attention is given to the role of presbyters (four pages) and the laity. As for the latter, though Auer considers "The Question of the Secular Office of the Laity," he never addresses the question of the religious office of the laity, that is, their ministry in the church and not just to the world. He broaches this theme in his section on " Vocations or Charisms, Ministries and Offices or Commissionings " (pp. 179-194), but all too quickly he concludes this section... (shrink)

John of Damascus (ca. 650/660 – 754 AD) is one of the first contemporary witnesses to critically examine the emergence of Islam and its holy scripture, the Qur’an. John came from a distinguished Melkite family that held political offices in state finance for generations. Like his father, he was initially a civil servant under the Arab rule of Caliph ‘Abd al-Malik (685 – 705). The anti-Christian movement that began in that time forced him to withdraw from public life and enter (...) the Mar Saba monastery near Jerusalem. While at the monastery, John grappled with the text of the “new” religion and defended the Christian position. In this milieu, the interpretation of the divine incarnation occupied a central position. By demonstrating the divine incarnation in Jesus Christ, John makes convergences with the Qur’anic movement of the new rulers. In doing so, he highlights the Qur’ans high esteem of the Virgin Mary as well as the birth and humanity of her Son, Jesus Christ. In this way, he seeks to bring Christianity into agreement with the Qur’an and to break down theological barriers. (shrink)

Failinger grand rapids, mi: eerdmans, 2016. 382 pp. $45.00In editing this collection of essays, Ronald Duty and Marie Failinger describe their goal as seeking "to bring more Lutheran voices (...) to the pressing legal issues" in local and global contexts (1). They point out that in discussions between the fields of religion and law to date, "Jewish, Muslim, Catholic, and Reformed perspectives have largely dominated" (1). In bringing Lutheran perspectives to questions of law and religion, this collection begins an important task of retrieving a theological perspective on law that was integral for the formation of modern legal thought but has been largely absent from contemporary discussions of law and religion.The strength of this collection of essays lies in the breadth of contemporary legal questions addressed and in the diversity of perspectives offered. Since, as Duty and Failinger point out, recent Lutheran scholarship has been relatively silent on questions of law and religion, there is a broad field of issues to explore. This collection avoids too narrowly focusing on any one "hot-button" issue of law and religion, such as questions of religious liberty or relationship between church and state, although these questions are addressed. Rather, it benefits from a truly expansive view of contemporary legal issues and includes essays on issues as diverse as immigration reform, family law, fiduciary duties, military chaplaincy, and water rights in the American Southwest. The collection also shows geographical breadth, and looks beyond the contemporary American and European legal arena to consider how theology could affect law in Nigeria and Rwanda. The volume also benefits from a wide range of theoretical approaches, including contributions from both legal scholars and theologians. In [End Page 211] the dialectic that results as theologians consider law and legal scholars consider theology, we see a performative example of the Lutheran concept of two kingdoms, both coexisting under God's domain.The collection would have benefited from a broader use of theological sources to accompany this admirably broad approach to legal issues. Many, although not all, of the essays, draw only on Martin Luther's understanding of Christian engagement with legal authority. This focus on Luther's somewhat limited legal corpus can result in a slightly repetitive theological approach among the essays. However, this narrow focus on Luther indicates a potential next stage for further development of Lutheran engagement with contemporary legal issues. In the closing essay in the book, "How Should Modern Lutherans Try to Shape Secular Law?," Robert Benne references John Witte's work in tracing how Philipp Melanchthon and the Lutheran jurists developed Luther's original theory of law to "build bridges between the two kingdoms" (332). While this book provides a good starting point for bringing Lutheran perspectives to bear on contemporary legal issues, it also indicates the need for future research to excavate the perspectives of Melanchthon and jurists such as Johannes Eisermann and Johann Oldendorp, along with more modern Lutheran scholars of law and religion, such as Helmut Thielicke, who considered the legacy of Lutheran legal theory in the wake of post-Nazi Germany. The causes of tidal motions were widely debated from antiquity up to the eighteenth century. These discussions got a second wind in the early modern period, in the wake of a growing number of cosmological alternatives that challenged the dominant Aristotelian-Ptolemaic stance. The 1687 publication of Isaac Newton’s Principia Mathematica was a defining moment in the discussions and consequently made universal gravitation the most credible and generally accepted explanation. This paper investigates the aftermath of Newton’s discovery and demonstrates how his (...) understanding of tidal motion crowded out competing theories within a broader European context. My main point of reference is Roger Boscovich’s De aestu maris (1747). In his work, the leading Jesuit scholar of the time contrasted Newton’s interpretation to those of other major authorities, namely Johannes Kepler, Galileo Galilei, and René Descartes, and went on to claim the superiority of the British scientist’s achievements over anything written prior to the Principia. As this essay argues, alongside a significant body of literature produced under the umbrella of the Jesuit order, Boscovich’s De aestu maris subsequently contributed to the formation of the popular image of Newton as a “scientific hero.”. The book examines the discourse on attention emerging in the European Enlightenment (1650-1780) with a focus on German philosophy and literature. It argues that this discourse influenced the formation of aesthetic philosophy in the eighteenth century. Notable figures discussed include René Descartes, G.W.F. Leibniz, Christian Wolff, and Alexander Baumgarten.

The unity of aesthetic and teleological judgment, the third and earlier Critiques, is based on Kant′s discovery of a “heuristic method” for applying judgments regarding sense phenomena to abstract thought, a “second attention” which enables an “idea of the whole”. Synthetic judgment, basis for cognition and human action, depends on efficacy of non-empirical insights: the transcendental standpoint, “regulative” ideas, consciousness of “ought” and the reality of freedom, universality of natural mechanism, the principle of “fortuitous” purposiveness. The activity of reflective judgment (...) in the encounter with the beautiful, sublime, living, and two paradigmatic types of explanation, inspired by Spinoza′s distinction of extensio and cogitatio, permit Kant to bridge the gap between freedom and necessity, theoretical knowledge and morality. In Western countries today, a growing number of women delay motherhood until their late 30s and even 40s, as they invest time in pursuing education and career goals before starting a family. This social trend results from greater gender equality and expanded opportunities for women and is influenced by the availability of contraception and assisted reproductive technologies. However, advanced maternal age is associated with increased health risks, including infertility. While individual medical solutions such as ART and elective egg freezing can (...) promote reproductive autonomy, they entail significant risks and limitations. We thus argue that women should be better informed regarding the risks of advanced maternal age and ART, and that these individual solutions need to be supplemented by a public health approach, including policy measures that provide women with the opportunity to start a family earlier in life without sacrificing personal career goals.
